A teacher in the northern cape has failed to return to work after being dismissed to use racial solution against two black students.
Gerhard Luv took the North Cape Education Department to the Education Council, arguing that his dismissal was unfair.
At that time, Luv was employed at Technical High School Kimberly, where he taught technology and motor vehicle subjects.
He was dismissed in November last year after two African students were found guilty in disciplinary hearing of calling the ke -ard.
The arbitration proceedings were held on 8 April and 22 May.

During the hearing, the Provincial Department called two students to testify.
The first witness in Grade 12 at the time of the incident, said she was among the seven girls, who were transferred from the North Cape High School Hostel to the Technical High School Hostel on the evening of 23 June 2024.
On his arrival, Luv – who was one of the observers in the hostel – emerged from his residence and expressed displeasure over the girls shifting to “their hostels”.
He testified that Luv expressed his disappointment to his driver, Mr. Tashbala.
After returning to Tashbala vehicle, Luv allegedly approached him and another pupil and accused him of tarnishing the school’s reputation, then called him a ke -ard.

He said that both he and other pupils were surprised, as he had done or did not say anything to provoke such a language.
He also indicated that a third pupil may hear the incident.
The disciple said during the cross-execution that he reported the incident to his families and the hostel’s center manager instead of Tashbala, who was groundsman and security chief.
Tashbala later advised him to report the matter to the authorities after the schools are reopen.
The second witness, which was mentioned the third pupil, confirmed the testimony of the first witness and said that Luv shouted at the girls in the presence of his wife.
Northern Cape Teachers refuse to use racial slur
Luv testified as the only witness in his defense.
He said that at the time of the incident, the hostel was captured by the boys attending Winter School and they felt that it was unfair for girls to stay there too.
The teacher claimed that the girls have warned that if they do not behave they would be asked to leave.
Luv insisted that he could not remember using a ke -ard.
He also said that neither the school management nor Tashbala informed him about the allegations and he only came to know about the matter when he was served with legal documents.

According to Luv, they did not see the girls again after the incident.
During the cross-examination, Luv admitted to being angry during the conversation, but again refused using the racial slur.
He also said that he could call his wife and another person to support the version of the events, as they were present during the conversation.
Whatever Luv claimed that it was inappropriate dismissal, asked for restoration on the basis.
Arbitration dismissal
One in 5 June rulingThe mediator found that the testimony of the two students was reliable and consistent, making them a reliable witness.
“The only refusal by the applicant is not enough to maintain a petition for not being guilty by facing allegations of this nature.
The use of the word “word ‘K **** R’ is not only illegal and derogatory to the humanity and dignity of learners, but it reminds us of our country’s terrible past,” reads the award.
The mediator also stated that Luv agreed with almost every detail of the accounts of the students, except for the use of racial slurry.
“If the applicant was really true about this, surely his wife and Mrs Van Der Lith would not have considered it a problem for coming to this council and confirming their version.”
Describing the behavior of the Luv as “low”, the intermediary concluded that the teacher was being fired, a suitable approval and “the case of final measures”.
Therefore, the dismissal was “quite fair”.
“In this democratic South Africa, people such as applicants are anti -conversion and should not be allowed to have good citizenship of children and our society.”
